Terms of Service

These terms are an agreement between you and Nebari Consulting LLC ("we", "us") covering your use of the Bonsai Journal app and the bonsai journal web pages it generates (together, "the service"). By creating an account or using the service, you accept these terms.

Subscriptions and purchases

Bonsai Journal is offered as an auto-renewing subscription (monthly or yearly) and as a one-time lifetime unlock, sold through the Apple App Store and Google Play. Current prices are shown in the app before you buy. Payment is processed by Apple or Google under their terms; subscriptions renew automatically unless you cancel in your App Store or Google Play account settings at least 24 hours before the end of the current period, and refund requests go through the store where you bought it. If your subscription lapses, you keep read-only access to everything you created; creating new entries and using the AI features require an active subscription or lifetime unlock. A purchase grants you a personal, non-transferable license to use the app on devices you own or control. It does not transfer ownership of the app or its code to you.

Your account

You are responsible for the credentials you use to sign in and for activity under your account. You must be at least 13 years old to use the service. We may suspend or close an account that violates these terms.

Your content

The photos, notes, and records you put into Bonsai Journal are yours. You grant us the limited rights needed to operate the service: storing your content, processing it to provide features you invoke (including the AI features below), and serving it back to you and to anyone you give a share link. We claim no other rights in your content. You agree not to upload content that is unlawful or that infringes someone else's rights.

AI features

Species identification, care guides, and Future Vision renders are produced by AI models and are labeled as such in the app. They can be wrong. Care guidance is general information about a species, offered to help you keep a journal; it is a starting point for your own judgment and local knowledge about your climate and your tree. Future Vision images are illustrative renders of what a tree could become. We make no promise that AI output is accurate, complete, or suited to your specific tree.

Share links

Creating a share link publishes a read-only view of your bench and tree journals to anyone who has the link. You decide whether to create one and who to give it to, and you can revoke it in the app. You are responsible for what you publish this way.

Acceptable use

You agree not to probe, overload, or interfere with the service, access it by automated means outside the app and its web pages, attempt to reach other users' data, corrupt shared resources such as the species care library, or use the AI features to generate content unrelated to keeping a bonsai journal.

Availability and changes

We work to keep the service available, and we may change, suspend, or discontinue features over time. If we ever discontinue the service as a whole, we will give reasonable notice so you can retrieve your content.

Disclaimer and limitation of liability

The service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. To the maximum extent permitted by law, Nebari Consulting LLC is not liable for indirect, incidental, special, or consequential damages, loss of data, or the health of any plant, and our total liability for any claim relating to the service is limited to the amount you paid for the app.

Apple-specific terms

If you downloaded the app from the Apple App Store: these terms are between you and Nebari Consulting LLC, not Apple. Apple has no obligation to furnish maintenance or support for the app and is not responsible for addressing any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Termination

You can stop using the service at any time and delete your account by emailing solutions@nebari.cc. We may terminate or suspend access for a violation of these terms. Sections covering your content, disclaimers, and liability survive termination.

Governing law

These terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law rules.

Changes to these terms

When we update these terms we will change the date at the top of this page. Continued use of the service after a change means you accept the updated terms.
